On March 5, 2018, all stormwater permits filed under the general permit TXR150000 with the
Texas Commission on Environmental Quality have expired. All construction sites now must refile
permit applications (Notice of Intent) to obtain stormwater permit coverage. The State of
Texas has given a 90 day time frame to get the new application filed with the TCEQ with NO
permits grandfathered. Each project that will be active or have stormwater exposure must be
covered with this new permit by June 3, 2018. If your project is going to be completed and
stabilized with vegetation before June 3, 2018 then no permit renewal is needed.
This new set of regulations will require your Storm Water Pollution Prevention Plan (SWPPP) to be modified and the language changes appropriately addressed. Also the new Notice of Intent (permit
application) must be resubmitted to the municipal operator. The permitting submittal process
will also be modified. The State of Texas will no longer accept paper Notice of Intent submittals
as of September 1, 2018. The only way to file permits after the September deadline is via the
TCEQ online submittal system called STEERS.
The last modification of this permit is that construction companies must minimize the exposure of waste materials by closing the waste container lid at the end of each work day. If the waste container does not have a lid then a temporary lid must be applied to minimize exposure to waste from precipitation.
